YUTELNEWS.com |  Kudus – Kronologi peristiwa hukum tentang polemik keberadaan bangunan The Sato Hotel. Pemuda No.77, Nganguk, Kramat, Kecamatan Kota Kudus, Kabupaten Kudus, Jawa Tengah berawal dari terbitnya IMB atau Ijin Mendirikan Bangunan. Tetapi saat ini perizinan pendirian bangunan telah berubah menjadi PBG (Persetujuan Bangunan Gedung).

Berdasarkan informasi sebelumnya The Sato Hotel Kudus mendapatkan ijin IMB berdasarkan keputusan Kepala Dinas DPMPTSP atau Penanaman Modal Dan Pelayanan Terpadu Satu Pintu Kabupaten Kudus. No. 644/106/15.04/2022 Tentang Izin Mendirikan Bangunan Gedung tanggal 29 Maret 2022. Sementara The Sato Hotel Kudus adalah milik Sri Endang Susilowati warga Jalan Sunter Hijau VI Blok H4 No. 14, RT/RW 012/010, Kelurahan Sunter Jaya, Kecamatan Tanjung Priok, Jakarta Utara.

Baik Kepala Dinas DPMPTSP Kabupaten Jepara dan Sri Endang Susilowati, keduanya menjadi Termohon Peninjauan Kembali I dan II. Keduanya menjadi Termohon oleh Benny Gunawan Ongkowidjojo (Pemohon, Red.) yang diwakili oleh kuasa hukumnya Dr. Budi Supriyatno, S.H., M.H., C.L.A dan kawan-kawan, advokat pada BEJ and Associates, Kabupaten Kudus.

Pemohon PK di MA RI yaitu Benny Gunawan Ongkowidjojo, setelah sebelumnya melakukan gugatan ke PTUN Semarang dan gugatan tersebut dikabulkan dengan Putusan Nomor 57/G/2022/PTUN.SMG, tanggal 8 Desember 2022. Namun kemudian ditingkat banding putusan tersebut dibatalkan oleh Pengadilan Tinggi Tata Usaha Negara Surabaya, dengan Putusan Nomor 16/B/2023/PT.TUN.SBY, tanggal 28 Februari 2023.

“Peninjauan Kembali atau PK.

Peristiwa selanjutnya Pemohon mengajukan permohonan Peninjauan Kembali atau PK disertai dengan alasan-alasannya yang diterima di Kepaniteraan Pengadilan Tata Usaha Negara Semarang pada tanggal 3 Agustus 2023.
Pemohon mengetahui dan menemukan bukti baru (novum), lalu melakukan upaya PK atau Peninjauan Kembali disertai dengan pengajuan novum sebagaimana Berita Acara Sumpah, Nomor 57/G/2022/PTUN.SMG, tanggal 4 September 2023.
Berdasarkan Memori Peninjauan Kembali yang diterima tanggal 3 Agustus 2023. Pemohon Peninjauan Kembali memohon kepada Mahkamah Agung untuk memberikan putusan sebagai berikut: 1. Menerima permohonan peninjauan kembali Pemohon Peninjauan Kembali/Terbanding/Penggugat dan 2. Membatalkan Putusan Pengadilan Tinggi Tata Usaha Negara Surabaya Nomor 16/B/2023/PT.TUN.SBY., tanggal 28 Februari 2023 yang dimohonkan Peninjauan Kembali.
Majelis Hakim Agung berpendapat pembangunan gedung Hotel Sato bertentangan dengan Pasal 21 ayat (1) Peraturan Pemerintah Nomor 16 Tahun 2021 tentang Peraturan Pelaksanaan Undang-Undang Nomor 28 Tahun 2002 tentang Bangunan Gedung juncto Pasal 21 ayat (1), ayat (2) dan ayat (3) Peraturan Daerah Kabupaten Kudus Nomor 4 Tahun 2014 tentang Bangunan Gedung.
Bahwa pembangunan The Sato Hotel/Hotel Beauty yang mengakibatkan kerusakan bagi rumah Penggugat, menunjukkan bahwa pembangunan tersebut tidak sesuai dengan prinsip mewujudkan tertib penyelenggaraan bangunan gedung yang menjamin keandalan teknis bangunan gedung dari segi keselamatan, kesehatan, kenyamanan sebagaimana ketentuan Pasal 3 Peraturan Daerah Kabupaten Kudus Nomor 4 Tahun 2014 tentang Bangunan Gedung. Bahwa sesuai Pasal 1 angka 17 Peraturan Pemerintah Nomor 16 Tahun 2021 tentang Peraturan Pelaksanaan Undang-Undang Nomor 28 Tahun 2002 tentang Bangunan diperoleh kaidah hukum bahwa perizinan bangunan gedung (PBG/IMB) haruslah sesuai standar teknis bangunan gedung, sedangkan standar teknis bangunan gedung Hotel Sato telah bertentangan dengan Pasal 1 angka 17, Pasal 21 ayat (1) Peraturan Pemerintah Nomor 16 Tahun 2021 tentang Peraturan Pelaksanaan Undang-Undang Nomor 28 Tahun 2002 tentang Bangunan Gedung junctis Pasal 3, Pasal 21 ayat (1), ayat (2) dan ayat (3) Peraturan Daerah Kabupaten Kudus Nomor 4 Tahun 2014 tentang Bangunan Gedung, maka sudah sepatutnya perizinan bangunan gedung/IMB hotel Sato (objek sengketa) dibatalkan dan dicabut. Yani No. 100, Kelurahan Panjunan RT 007 RW 003, Kecamatan Kota Kudus, Kabupaten Kudus, Jawa Tengah, Kamis (1/2/2024) siang, bertempat di Taman 1000 Merpati, Kudus, mengadakan acara jumpa pers tentang hasil putusan permohonan Peninjauan Kembali (PK) dari Mahkamah Agung RI.

Benny Gunawan Ongkowidjojo dan Benny Djunaedi mendampingi kuasa hukumnya Dr. Budi Supriyatno, S.H., M.H. C.L.A dari BEJ & Associates. Dalam jumpa pers ini, Dr. Budi Supriyatno, S.H. membacakan salinan hasil putusan MK tentang hasil upaya PK ke Mahkamah Agung RI.
Majelis Hakim Mahkamah Agung RI memutuskan hasil putusan nomor 212 PK/TUN/2023 (15/12/2023) yaitu mengadili 1. Mengabulkan permohonan peninjauan kembali dari Pemohon Peninjauan Kembali Benny Gunawan Ongkowidjojo, 2. Membatalkan Putusan Pengadilan Tinggi Tata Usaha Negara Surabaya
Nomor 16/B/2023/PT.TUN.SBY, tanggal 28 Februari 2023. Mengadili Kembali : 1. Mengabulkan gugatan Penggugat untuk seluruhnya, 2. Menyatakan batal Keputusan Kepala Dinas Penanaman Modal Dan Pelayanan Terpadu Satu Pintu Kabupaten Kudus Nomor : 644/106/15.04/2022 Tentang Izin Mendirikan Bangunan (IMB) Gedung tanggal 29/03/2022, 3. Mewajibkan Tergugat untuk mencabut Keputusan Kepala Dinas Penanaman Modal Dan Pelayanan Terpadu Satu Pintu Kabupaten Kudus Nomor: 644/106/15.04/2022 Tentang Izin Mendirikan Bangunan Gedung tanggal 29/03/2022, 4. Menghukum Termohon Peninjauan Kembali I dan Termohon Peninjauan Kembali II membayar biaya perkara pada semua tingkat pengadilan, yang pada peninjauan kembali ditetapkan sejumlah Rp2.500.000,00
(dua juta lima ratus ribu Rupiah) dan diputuskan oleh Majelis Hakim pada hari Jum’at, tanggal 15 Desember 2023, oleh Dr. Irfan Fachruddin, S.H., C.N., Hakim Agung sebagai Ketua Majelis, bersama Dr. Cerah Bangun, S.H., M.H., dan Dr. H. Yodi Martono Wahyunadi, S.H., M.H. sebagai anggota, dan Mohamad Yusup, S.H., Panitera Pengganti tanpa dihadiri oleh para pihak.

Sesuai pembacaan salinan hasil putusan MA oleh Dr. Budi Supriyatno kepada awak media yang hadir, baik dari media cetak dan online. Benny Gunawan Ongkowidjojo dan Benny Djunaedi, keduanya mengatakan agar Pemkab Kudus segera menutup operasional The Sato Hotel Kudus.

“Karena IMB dicabut, mohon pihak-pihak yang berwenang segera melakukan pembongkaran bangunan The Sato Hotel,” katanya.
“Kami meminta penutupan dan pembongkaran bangunan The Sato Hotel Kudus,” pungkas Benny Gunawan Ongkowidjojo yang diiyakan oleh Benny Djunaedi.
