Sebagaimana Pra Peradilan PT. Pelayaran Nasional Jaticatur Niaga Trans, Tanggal 20 Pebruari 2024 Pengadilan Negeri Batam memenangkan Pra Peradilan PT. Pelayaran Nasional Niaga Trans dengan putusan Nomor 1/Pid.Pra/2024/PN Btm yang ditandatangani hakim David P Sitorus SH MH dan Panitera Pengganti Romy Aulia Noor SH.
Dalam amar keputusan pengadilan memerintahkan Gakkum KLHK Batam mengembalikan kepada PT Pelayaran Nasional Jati Catur Niaga Trans, anggota Hiplindo (Himpunan Pengusaha Lira Indonesia) semua benda-benda atau barang-barang yang telah disitanya dalam keadaan baik dan utuh, berupa Fuel Oil sebanyak 5.500.538 Kgm (+/- 5.500 ton), Kapal MT Tutuk GT 7463 milik PT Pelayaran Nasional Jati Catur Niaga Trans, dan Kapal MT Mars.
Pengadilan juga menyatakan penetapan tersangka Wiko, Direktur PT. Pelayaran Nasional Jaticatur Niaga Trans dan PT. Pelayaran Nasional Jaticatur Niaga Trans atas dugaan pelanggaran UU Lingkungan Hidup Nomor 32 Tahun 2009, Pasal 106A membawa Limbah B3 ke Wilayah Indonesia, tidak sah.
Lebih jauh pengadilan negeri Batam juga meminta Gakkum KLHK Batam untuk menghentikan penyidikan dalam kasus MT. Tutuk yang membawa muatan 5.500 ton Fuel Oil dari Malaysia Ship To Ship di Peraian Batam menuju ke China.
