Kemudian terdakwa sangat keberatan terhadap vonis hakim terhadap dirinya, sehingga terdakwa bersama kuasa hukumnya mengajukan upaya hukum banding terhadap putusan nomor 5/JN/2023/MS-Bir, cetus terdakwa di dampingi pengacaranya.
Kemudian upaya hukum banding terdakwa berubah manis meskipun tidak sesuai harapan, terdakwa di sangkakan telah melakukan Jarimah pada sekira Agustus 2022 ,kemudian korban melaporkan perkara tersebut pada September tahun 2023 ke polres Bireuen artinya dugaan/tuduhan tersebut sudah berselang lama tetapi kenapa baru 2023 di laporkan sehingga terdakwa ini yang membuat terdakwa tidak bisa menerima, namun terdakwa bejuang untuk mencari keadilan tetapi pengadilan tingkat banding membatalkan putusan mahkamah Bireuen dan menerima permohonan banding terdakwa yaitu dari hukuman kurungan badan menjadi uqubat ta’zir cambuk 24(dua puluh empat bulan) dan di kurangkan seluruhnya dari hukuman yang dijatuhkan sebagaimana dalam isi putusan nomor 8/JN/2024/MS-Aceh yang di terima oleh terdakwa pada tanggal 19 Febuari 2024 di lapas biruen.
